MASAK’s final reports found no unexplained, suspicious, unrecorded or terrorism-financing transaction. The State’s own competent financial authority did not substantiate the accusations against the Koza İpek Group or the İpek family.

Despite those findings, İpek University and İpek Media were confiscated in 2016 through emergency decrees, without an individualised reason and without a lawful justification capable of overriding MASAK’s conclusions.

Official, recorded donations made to İpek University before its closure, and official capital increases made in İpek Media while it was lawfully operating, were later treated as financing terrorism. Transactions that were lawful, transparent and recorded when made were retrospectively turned into the alleged basis for confiscation.

The Group’s other companies were not confiscated because of any offence, transaction or evidence specific to them. They were taken simply because they belonged to the same corporate group as İpek University and İpek Media. Corporate association was substituted for individual evidence and personal criminal responsibility.

The Koza İpek Group was stripped of İpek University and İpek Media by emergency decree in 2016. That State-created loss was then used against the Group itself. In plain terms: the Group was first robbed by decree, and was later arbitrarily seized because it had been robbed—without a lawful basis and contrary to the most elementary principles of property and criminal law.

The owners were not convicted; the prosecutor had not sought confiscation of every company; and the affected owners were not given a proper opportunity to answer the expanded measure. İpek Investment maintains that this was not lawful confiscation but an arbitrary taking of the entire corporate estate.
